The Fashion Law is reporting that Gucci has prevailed in its trademark infringement claim against Guess. Gucci sued over multiple designs that it claimed misappropriated trademarked Gucci design elements. Interestingly, though, the judge awarded only a fraction of the damages that Gucci had sought, allowing the company to recover Guess’ profits off the infringing items but not for Gucci’s claimed lost profits. In pure legal geek fashion, I’d be interested to get my hands on a copy of the opinion for the judge’s reasoning on the damages. But, I’ve always thought proving that, if it weren’t for a knockoff product, consumers would have purchased the original is at best a tenuous proposition, especially in a case where there’s a serious difference in price and market appeal. It’s hard for me to imagine that Gucci and Guess are focusing on anywhere near the same demographics of shoppers, and it maybe that the judge felt the same.
